Terms and Conditions for the Purchase of Goods or Services Online

  1. These are the terms and conditions on which we supply products to you, whether these are goods, services or access to our video content.

  2. Please do read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you have any questions or concerns regarding these terms, please contact us to discuss.

  4. We are Desired FX; a UK registered sole trading company. Our registered office is at 48 King John Road, Gillingham Dorset, SP8 4PG

  5. You can contact us by emailing our customer service team by writing to us at email: contact.desired.fx@gmail.com; or the registered office address in 2.1 above.

  6. If we have to contact you we will do so by message feature on the website or by writing to you at the email address or postal address you provided to us in your order.

  7. “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

    Product Order Process:

  8. We will message you when we have received your order and when it is dispatched.

  9. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the product. This may be (but is not limited to) because the product is out of stock, because of unexpected limits on our resources that we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified. This includes the shipping upgrade to trackable postage and will be done through writing messages or email.

  10. We will assign a reference number to your order which will be related to your account profile with us. This will show on your order. It will help us if you can state the order number whenever you contact us about your order.

  11. If you have purchased our products with trackable shipping, the tracking number will be provided on the order.

    Our products:

  12. Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Product packaging may vary to minimise package waste. The packaging of the product may vary from that shown in images on our website.

  13. Our temporary tattoos are FDA verified and skin safe. Please read the instructions and use the patch test 24 hours (which we have provided in the form of a small black heart tattoo) before applying the product, even if you have never experienced an allergic reaction before. If you have any reaction please discontinue the use of the product. The temporary tattoos should last up to 7 days subject to a few factors: location on the body, quality of application process and how exposed it is to wear and tear ( whether from friction, environment or other substances).

  14. For our prosthetic products, adhesives are currently not provided. Please make sure the adhesives you use do not cause an allergic reaction.

  15. Our rights to make changes:

  16. Minor changes to the products. We may change the product:

    1. to reflect changes in relevant laws and regulatory requirements; and

    2. to implement minor technical adjustments and improvements. These changes will not affect your use of the product

      Providing the products:

  17. The costs of delivery will be automatically calculated for you on our website, depending on the delivery destination, shipping method and postal charges.

  18. During the order process, we will let you know when we will provide the products to you.

  19. In the unlikely event, that the product information such as (but not limited to) weight or dimensions has changed, we will contact you before finalising and dispatching the order.

  20. If the products are goods, we will deliver them to you within the delivery times selected at checkout. We will dispatch within 1-2 working days after the day upon which we accept your order provided correct delivery details have been given. If you order within the UK, the expected delivery time is 2-3 working days from standard shipping and you are able to upgrade your shipping to trackable or faster shipping. If you live outside the UK, the shipping will take around 7 working days.

  21. Missing goods – please note that our orders are checked for content and checked against an order list before dispatch. Therefore it is extremely unlikely that a mistake will be made in respect of the content. If we suspect a fraudulent claim or if there are repetitive claims by an individual, then at our discretion we will not replace the missing goods. There will not be any refund for standard shipping. If the order is lost by the mail carrier, we cannot be held responsible. We recommend you upgrade your shipping.

  22. Invoice and packaging in the state when first opened will be required as photographic evidence in order for us to investigate any claims of missing items.

  23. We are not responsible for delays outside of our control. If our supply of the products is delayed by an event outside of our control then we will contact you as soon as possible to make you aware and we will take steps to minimise the effect of the delay. We will not be liable for delays caused by the event, however, we will provide links and information to help you in the investigation of the cause of the delay.

  24. The customer is responsible for providing us with the correct shipping details. We cannot be held responsible for deliveries made to incorrect or incomplete addresses provided by customers. We post all orders to the address that you provide us with, so please check your order confirmation email to ensure that the address is completely correct. If you have paid with PayPal, please double-check that your PayPal delivery address is correct. If you spot a mistake please email us to let us know as soon as possible so that we can have this amended before shipping. In any instance where the address that you have provided is not 100% correct, and your order is shipped, we will need to wait for the parcel to be returned if we are to provide any kind of re-delivery/refund.

  25. If you deem your product(s) to be damaged or faulty, you will need to contact us within 5 working days of receiving your item(s) to make us aware of the issue. If you contact us regarding your product(s) being damaged or faulty outside of this time frame it will be down to the discretion of the management as to whether you are eligible for an exchange or refund. You will need to provide photographic evidence before we can process any solution.

  26. After contacting us about the damaged or faulty product(s), you will need to send the products to our office within 14 days. If we do not receive the returned product(s) within 30 days, you will no longer be eligible for an exchange or refund.

  27. Cancellation: we are unable to accept any order cancellations. Please double check your order at the checkout; you will not be able to cancel your order once it has been placed.

    If there is a problem with the product:

  28. If you have any questions or complaints about the product, please contact us. You can email our customer service team at contact.desired.fx@gmail.com or write to us at our postal address set out in clause 2.1. You must notify us in writing where you have a claim for faulty products within 5 working days of delivery. Please email or write to customer services (details above) setting out full details of your claim or description of the fault with the product as stated in clause 6.

  29. Price and payment:

  30. The price of the product (which includes VAT) will be the price indicated on the website order pages when you placed your order. We use our best efforts to ensure that the price of the product advised to you is correct. However please see clause 8.3 for what happens if we discover an error in the price of the product you order.

  31. We will pass on changes in the rate of VAT: if the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect. The prices shown on the website are VAT inclusive.

  32. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced on our website. We will normally check prices before accepting your order so that, where a product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product’s correct price at your order date is higher than the price stated to you, we will contact you for your confirmation before we accept your order.

  33. We accept payments as allowed through the Wix Payment system. For Goods, you must pay for the products before we dispatch them.

  34. Discount codes: Only one discount code can be used per order.

  35. How we may use your personal information:

  36. We will only use your personal information as set out in our Privacy Policy.

    Other important terms:

  37. We may transfer our rights and obligations under these terms to another organisation.

  38. You need our consent to transfer your rights to someone else: you may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.

  39. Nobody else has any rights under this contract; no other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.

  40. If a court finds any part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

  41. Even if we delay in enforcing this contract, we may still enforce it later. If we do not insist immediately that you comply with these terms, or if we delay in taking steps against you in respect of your breaking this contract, this does not exempt you from these terms and it does not prevent us from taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

  42. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
